REDBEARD’S RANCH WAIVER AND RELEASE OF LIABILITY This form, with valid signature, must be on file for each camper at Redbeard’s Ranch. WARNING: · “Under Missouri law, an outfitter is not liable for an injury to or the death of a participant in paddlesport activities resulting from the inherent risks of paddlesport activities pursuant to the Revised Statutes of Missouri." RSMO 537.327 · “Under Missouri law, an Equine Professional is not liable for an injury to or the death of a participant in equine activities resulting from inherent risk of equine activities pursuant to the revised statutes of Missouri.” Missouri Equine Council 1-800-313-3327 www.mo-equine.org. In consideration for my being permitted to participate in the activities of Redbeard’s Ranch LLC, I agree to the following waver and release: 1. Assumption of Risk: I acknowledge that Inherent risks, dangers and hazards and such exist when participating in rafting, kayaking, camping, fishing, canoeing, equine activities or hunting activities. § Participation in such activities and/or use of such equipment may result in injury or illness or death or damage to personal property. § These risks and dangers may be caused by other participants, or by accidents, or by the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, entering, exiting and operating the watercraft, dangerous water conditions, entrapment, injury from slips and falls, temperature and weather extremes, animal behavior, selection of trail or river route, weather conditions, risks of falling out of a raft, canoe or kayak and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment. Further, activities may take place in remote places, significantly delaying emergency medical care. Participants should wear footwear which will provide protection from sharp objects, and which will minimize the risk of foot entrapment. § Provider has made no effort to determine, and accepts no responsibility for medical, physical or other qualifications or the responsibility for determining Participant’s suitability for participating in the activities. § Consumption of even small quantities of alcohol and other substances will impair judgment and reduce a participants ability, or the ability of others, to effectively manage the risks of water travel, camping and land activities. Consumption of alcohol or any combination of alcohol, controlled substances or drugs while using REDBEARD’S RANCH float equipment is prohibited. The participant knows and understands the scope, nature, and extent of the risks involved in activities contemplated by the agreement and voluntarily and freely chooses to incur such risks. The participant agrees to abide by all of REDBEARD’S Ranch’s rules and regulations. Participant and the parent/guardian/custodian of a minor Participant, acknowledges and understands that the description of activities and risks above is not complete and that all activities, whether or not described, may be: dangerous and may include risks which are inherent and cannot be responsibly avoided without changing the nature of the activity. 1. Exemption from Liability The Participant fully assumes all risks associated with camping, river activities, horseback riding and hunting and exempts and releases "REDBEARD’S RANCH ", its owners, officers, agents, servants, employees, and lessors from action whatsoever arising out of any damage, loss or injury to the participant or the participant’s property while upon the premises or using any equipment of the corporation or while participating in any of the activities contemplated by this agreement whether such loss, damage, or injury results from the negligence of the corporation, its officers, agents, servant, employees or lessors or from some other cause.
2. Covenant Not To Sue The participant agrees never to institute any suit or action at law otherwise against " REDBEARD’S RANCH ", its owners, officers, agents, employees, servants or lessors nor to initiate or any way assist the prosecution of any claim for damages or course of action which the participant, participant’s heirs, executors or administrators hereafter may have by reason of injury to the person of the participant or to the participant’s property arising from the activities contemplated by this agreement.
3. Indemnity Against Third Party Claims The participant will indemnify, save and hold harmless " REDBEARD’S RANCH ", its owners, officers, agents, servants, employees or lessors, from any and all losses, claims, actions, or proceedings of every kind and character which may be presented or initiated by any other persons or organizations and which arise directly or indirectly from the actions of the participant while engaged in the activities contemplated by this agreement.

Notice: Management reserves the right to refuse service to anyone. By signing below, the undersigned assumes full responsibility for any and all equipment issued and agrees to reimburse " REDBEARD’S RANCH " LLC for any replacement or repairs necessary to return equipment to its original condition. I hereby acknowledge that I have CAREFULLY read all of the provisions above, fully understand the terms and conditions expressed there, and do freely choose acceptance of the provisions of the foregoing paragraphs relating to assumption of risk, exemption from liability, covenant not to sue, indemnify against third party claims, and continuation of obligations. Parents may sign for minors – include name and age of minor in printed information.
